Legacy Customer Terms

This agreement, which is signed by both Deep Earth Press and the client enrolled in the Legacy Book program (whatever you want to call it) is between Deep Earth Press, LLC (referred to as we/us) and the participant (referred to as you).

Terms and Conditions:

  1. By participating in this program, accessing any video or training materials or attending any sessions contained within this program, you agree to be bound by this agreement. This automatically becomes a binding contract between us and acknowledges that you have read, understood, agree to and accept all terms and conditions contained within this agreement without modification by you.

  2. Deep Earth Press reserves the right to update this agreement at any time and provide you with an updated version that will take effect immediately.

Program Description:

The Legacy Book Package offered by Deep Earth Press is a 90-day (approximate) process whereby we work with you, the client, to bring into creation a book containing agreed-upon specifications. By agreeing to these terms and conditions, you agree to the (3) four-week timelines contained within this process.

Payments:

  1. Payments are processed through our website via Stripe, Square, PayPal, or Apple Pay

  2. There are no refunds.

    1. Payment plans will be available in ⅓ installments (each ⅓ takes place within a 30-day cycle) and the option to pay in full upfront.

  1. If they are using a payment option:

In the case of non-payment, the client’s project is put on hold. Files are saved, and no further work is done on the project until payment is received.

Payment Plan transactions are scheduled. If a payment does not go through, it will try again in 5 days. If payment is not received after the second attempt, it will try again in another 5 days (10 days after initial attempt). If payment is again not received, the project and billing cycle is canceled.

  1. Extensions to the Timeline

    1. An extension in time to pay, after the automatic 10-day late payment attempt, a request to extend the project timeline for 30 days will cost an additional $750 (10 hours at $75/hr) in order to readjust our workflows

Termination of this Agreement

  1. All purchases are final. If you, the client, decide to terminate the project at any time, you are free to terminate any payment plans you have made through our website to stop any future payments. We reserve the right to terminate this agreement at any time, for any reason.

The work on the client’s end takes place during the first payment cycle (the first ⅓ payment, the first 30 days). If a client fails to do the work within that first payment cycle, work will be stopped and payment will stop until the work the client owes us is fulfilled.

We will save their files in case they would like to resume the project in the future, but they, personally, will not have access to the files. If an ongoing subscription is terminated, the customer will no longer have access to the subscription content. If a subscription is for a workshop and they pay in full, they will forever have access to that content.

  1. At the completion of the project, the client will receive a custom URL to then purchase copies of their book from.

Confidentiality and Privacy

  1. We respect your confidentiality and privacy.

All information provided to us, during the sales process and through the creation of your book, is held in the strictest of confidence. We do not sell any of your information to third parties.

The legacy books are private books, not available to buy through distributors or bookstores. They have no ISBN. we would like to have a liability agreement for customers to sign to promise they haven’t plagiarized material or are infringing on anyone else’s rights.

We own the intellectual property of the files we create. The customer owns the rights to their own, unedited, content, such as pictures they provide. The documents, edited content, book layout, etc are all owned by Deep Earth Press.

We own all rights to correspondence, electronic recordings, and images from meetings.

  1. Whatever you decide in 1.4, do they have the right to approve your use or not?

If we want to use any recorded material, we would have those involved sign a consent form.

  1. Whatever you decide in 1.4, you would want them to hold you not responsible for any perceived harm to them for your use of those things.

  1. You, the participant should agree not to share, reproduce, distribute, copy, teach, etc. any intellectual property created and provided by Deep Earth Press.

  1. Participate agrees:

    1. That all of the terms and conditions are fair and necessary for the protection of Deep Earth Press.

    2. If you violate or threaten to violate this agreement, Deep Earth Press would be entitled to take legal action to prevent such a violation. In the event that you violate this agreement, Deep Earth Arts will be entitled to pursue financial recompense.

Ownership Rights

  1. Deep Earth Press owns all intellectual property (files, layouts, edited work) created for the legacy book.  The participant owns the physical copies of the book Deep Earth Press created for them.
